Terms of Service

1. General Provisions & Contract Formation

These Terms of Service (hereinafter: Terms) govern the legal relationship between the service provider EOFH Development (operated by a private individual / non-incorporated service provider, email: info@eofh.ee) and the customer (hereinafter: User or Customer) regarding FiveM server hosting, Discord bot hosting, scripting, and related services.

By accessing eofh.ee, utilizing EOFH services, or joining our Discord server, the User agrees to be bound by these Terms in full.

2. Service Provision & SLA Uptime

EOFH provides the following services:

• FiveM roleplay server virtual hosting (Wanderer, Adventurer, Ruler plans);
• Discord bot hosting & custom system integration;
• FiveM script installation, debugging, and optimization;
• Custom vehicles, uniforms (KGB, Military, EMS), and web store setups.

EOFH commits to an annual server availability target of at least 99.9% (SLA). Uptime target excludes scheduled maintenance (up to 4 hours per month) and force majeure events.

3. Acceptable Use Policy (AUP)

The Customer agrees to use EOFH infrastructure solely for lawful purposes. Prohibited activities include:

• Initiating DDoS/DoS attacks, hosting malware, trojans, or botnets;
• Distributing copyrighted content without permission or violating intellectual property;
• Violating official Cfx.re / FiveM Terms of Service and license rules;
• Cryptocurrency mining or intentionally exhausting server resources;
• Disrupting other customers or third-party networks.

4. Payments, Billing & Refund Policy

Services are billed prepaid according to the chosen package or custom quote. In case of non-payment, EOFH reserves the right to suspend services after a 3-day notice.

Right of Withdrawal: Under EU Consumer Rights Directive and Estonian Obligations Act, statutory 14-day withdrawal rights do not apply to digital content or immediate virtual services once performance has begun with explicit consent.

5. Limitation of Liability

EOFH is not liable for data loss caused by Customer configuration errors, faulty third-party scripts, or external cyber attacks. Customers are required to maintain independent off-site backups.

EOFH's total aggregate liability for any claim shall not exceed the amount paid by the Customer in the last 30 days.

6. Governing Law & Dispute Resolution

These Terms are governed by the laws of the Republic of Estonia and applicable EU regulations. Disputes shall be settled through amicable negotiation or in Harju County Court, Tallinn, Estonia, or via the EU Online Dispute Resolution platform.
